Yoloo offers you calling and text messaging services through Yoloo’s licensed software application «Licensed Application» for mobile devices available on Yoloo’s website https://www.yoloo.online «Site» or other third party websites. The Site, the Licensed Application and the various Yoloo services offered to you may be collectively referred to in these terms as the «Service». You understand that, just like a regular mobile phone service, anyone with knowledge of your phone number may call you or send you messages through our Licensed Application. Yoloo Licensed Application is licensed, not sold, to you for use only under the terms of this license, based on a separate license agreement accepted by you. We reserve all rights not expressly granted to you. This license is a binding legal document between Yoloo and you and explains your rights and obligations as a user of the Service «License». By using the Service you acknowledge and agree to the terms of this License and the Yoloo Privacy Policy. If you choose to not agree with any of these terms, you may not use the Service.

NO ACCESS TO EMERGENCY SERVICES: Yoloo is not a replacement for your ordinary mobile or fixed line telephone and does not allow you to make emergency calls to emergency services. You must make alternative communication arrangements to ensure that you can make emergency calls if needed.

• Yoloo shall effect such termination by preventing your access to the Service, where applicable. We reserve the right to cancel User Accounts that have been inactive for more than one (1) year.

The Service

• Once you have downloaded the Licensed Application and become a Yoloo user, you can call any other Yoloo user for free. In addition, Yoloo offers you the opportunity to become a «Yoloo Offnet» user (PSTN lines calling), which allows you to call non-Yoloo users around the world at the rates set forth in paragraph 10 below.
• In the course of using the Service, you may encounter content that may be deemed offensive, indecent, or objectionable. Nevertheless, you agree to use our Service at your sole risk and we shall not have any liability to you for content that may be found to be offensive, indecent, or objectionable. You agree not to exploit the Service in any unauthorized way whatsoever, including but not limited to, trespassing or burdening network capacity.
• We make no representation that our Service is available for use in any particular location. To the extent you choose to access our Service, you do so at your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws. We reserve the right to change, suspend, remove, or disable access to our Service at any time without notice. In no event will we be liable for the removal of or disabling of access to our Service. Yoloo will not be liable for any loss that you may incur as a result of someone else using your User Account, either with or without your knowledge. In addition, you may be held liable for any losses incurred by us or another party due to someone else using your User Account. Therefore, we recommend that you choose a password that is hard to guess and consists of letters, numbers and symbols.

You may not:

• intercept or monitor, damage or modify any communication which is not intended for you;
• use any type of spider, virus, worm, trojan-horse or any other codes or instructions that are designed to distort, delete, damage, emulate or disassemble the Service;

End Users and Export Control

You will not use or export the Licensed Application or any product or service offered on the Site or through the Service, in violation of any applicable laws or regulations.

Charges for Yoloo Offnet Service.

• Calling non-Yoloo phone numbers and premium rate numbers with Yoloo Balance:

  • The charges payable for calling landlines and mobile phones outside of the Yoloo network consist of a per-minute rate as set out on https://yoloo.online/rates. All calls will be disconnected and require a re-dial after a 1-hour duration.
  • Yoloo may change the rates for calling phones at any time without notice to you by posting such change at  https://yoloo.online/rates. The new rate will apply to your next phone call after the new rates have been published. Please check the latest rates before you make your call. If you do not accept the new rates, do not make your call.
  • The duration of a call shall be based on one-minute increments. Fractions of minutes will be rounded up to the next minute. At the end of a call, fractional cent charges will be rounded up or down to the nearest whole cent. For example a total call price of €0.034 will be rounded to €0.03. During the call, charges incurred will be deducted automatically from the Yoloo Balance in your User Account.
• From time to time, Yoloo may offer products or features available at no charge for a trial period. However, Yoloo reserves the right to charge you for such products (at the normal rate) in the event that Yoloo determines (in its reasonable discretion) that you are abusing the terms of the offer, including if you are using any service, proxy or other devices or anonymous IP address that prevents us from locating you.
• Yoloo may collect VAT or other indirect taxes at the appropriate rate for the particular territory (as per applicable tax rules) at the time of Yoloo Balance top up.
• Using the Licensed Application on mobile applications will use some of the data allowance available on the data package to which you have subscribed with your mobile network operator. Out-of-country usage may lead to significantly higher costs than regular usage, and you are solely responsible for keeping yourself informed and paying for possible roaming and other applicable charges levied by your mobile network operator.

Payment - Yoloo Balance.

• You can top up Yoloo Balance using any payment method made available to you by Yoloo from time to time. Your top up will be applied to your Balance at the time of purchase. We use the services of third parties to process your payments and we require that these third parties take the appropriate organizational and technical measures to protect your personal data and traffic data and to comply with relevant laws. Please review the terms of use and privacy policies of those third parties before providing your banking or payment information.
• If you do not use your Yoloo account for a period of 365 days, Yoloo will place your account on inactive status. Any credit remaining on account at this time will be lost, unless you specifically write to us at support@yoloo.online within a 14 day period after the account has been made inactive
• Any charges mentioned in specific currencies are solely considered as examples, and do not take currency fluctuations or discrepancies into account.

Refunds

• No refunds will be given for any charges more than 90 days old.
• Yoloo reserves the right to refuse a refund request if it reasonably believes (i) that you are trying to unfairly exploit this refund policy, for example, by making repetitive refund requests in respect of the same product or feature; (ii) if you are in breach of the terms of this License; or (iii) if Yoloo reasonably suspects that you are using any of our products fraudulently or that your User Account is being used by a third party fraudulently. This refund policy does not affect any of your statutory rights to pursue a claim.

Yoloo's Ownership Rights

The Service, including the Site and Licensed Application (including any content or information contained therein) and all copies thereof are protected by copyright and other intellectual property laws and treaties. Yoloo owns the title, copyright, and other intellectual property rights in the Site, Licensed Application and Service and all copies, modifications and derivative works thereof, and the underlying software «Yoloo Researches», and your use of our Service does not grant to you, nor do you acquire any ownership rights in the Yoloo Researches.

Notice concerning Copyright infringement

We respect the intellectual property rights of others, and require that the people who use the Site, Service and Licensed Application do the same. The laws of the Hong Kong govern this License and your use of the Licensed Application. Yoloo needs to collect information so that we can manage your relationship with us. ”Personal Information" means the information about you that is personally identifiable, like your name, address, e-mail address, billing information, or phone number, as well as other non-public information that is associated with this personal information. "Anonymous Information" means the information that is not personally identifiable, or linked to your Personal Information such as aggregated information, general demographic information and IP addresses. Collection And Use Of Information

Yoloo Apps

When you install the Yoloo Apps or register on the Site, you will be asked to provide us with your phone number, email address, name and a photo (name and photo are not mandatory) and to allow us access to your mobile device's address book.

A copy of the phone numbers and names in your address book (but not emails, notes or any other Personal Information in your address book) will be stored on our servers and will only be used to:

• indicate which of your contacts is already a Yoloo user,
• correctly display the name of each contact as it appears in your address book when a call is received,
• synchronize your contacts with other Yoloo applications or active Yoloo instances.

The copy of your address book (names and phones) is stored on a live database. This database does not have a "historical backup". If you delete the address book from our servers (more about this below), it will be deleted instantly and permanently.

Your phone number will be used for identification purposes as your Yoloo user ID.

As other Yoloo users may add your Yoloo number to their address book and see that you registered to Yoloo, we do not consider the fact that your number exists as a Yoloo number as private information.

Yoloo also maintains a Call Detail Record (CDR) for each message and call that goes through the system. These are industry standard records used by all phone companies. We maintain this information in order to better understand network behavior and trends, detect potential outages and technical issues and for public safety reasons. All log analysis is done in an anonymous, aggregate, non-personally identifiable manner. We may look into a specific Call Detail Record in response to a customer support request. We maintain CDRs for a period of no more than 12 months.

Audio calls by users are transmitted either directly from user to user or, if direct transmission is not possible (due to, for example, firewalls), Yoloo servers are used to transmit the call. In the latter scenario, the information transmitted is stored briefly in volatile memory (RAM) solely to enable the transmission of the call to the other user. WE DO NOT RECORD ANY PART OF YOUR CALL.

Yoloo may interact with your phone's SMS inbox or call history for the sole purpose of service activation, placing incoming messages in your inbox, reading the contents of the activation SMS sent to you by Yoloo. WE WILL NOT ACCESS THE CONTENTS OF ANY OTHER SMS.

Name and Photo

Should you provide your name and/or photo it will be visible to other Yoloo users as long as such users have your Yoloo number.

Online Status and Seen Status

Other users will see your connection status (whether you are online or not) as well as whether you saw messages they sent to you.

Yoloo Offnet (to PSTN lines) calling

We use the services of third parties to process your payments and we require that these third parties take the appropriate organizational and technical measures to protect your personal data and traffic data and to comply with relevant laws. Please review the terms of use and privacy policies of those third parties before providing your banking or payment information.

Analytics Collection

Yoloo uses Google Analytics to help us anonymously track and report user/visitor behavior information and users' standard log information to the Site and the Yoloo App. This information (including but not limited to: IP address, data storage, maintenance services, database management, web analytics and information processing) helps us analyze and evaluate how the Yoloo App and Site are used as part of our ongoing efforts to improve the Site and Yoloo App's features and services. No personally identifying data is included in this type of reporting. Google Analytics may have access to your information only for the purposes of performing these tasks and on behalf of Yoloo and under obligation similar in those in this Privacy Policy. We will never (and will not allow any third party to) use the statistical analytics tool to track or to collect any Personal Information of visitors or users. Google will not associate your IP address with any other data held by Google. Neither we nor Google will link, or seek to link, an IP address with the identity of a device user. We will not associate any data gathered from this site with any Personally Identifiable Information from any source, unless you explicitly submit that information via a fill-in form on our website. 

If you do not want your information to be part of this statistical information gathering, you can disable Google Analytics using the application settings; visit the 'More' screen, tap settings, then disable Google Analytics Collect Data option.

Sharing And Disclosure Of Information

We do not rent, sell, or share any information about our users with any third-parties, except as specifically described herein. We may disclose your Personal Information if we believe such action is necessary to:

• comply with the law, or legal process served on us;
• protect and defend our rights or property (including the enforcement of our agreements);
• or act in urgent circumstances to protect the personal safety of users of our Service or members of the public.

In order to provide you with Yoloo products you have requested, Yoloo may sometimes, if necessary, share your Personal Information (excluding your address book and related information) and traffic data with trusted partner service providers and/or agents, for example: banking organizations or other providers of payment and analytical services, customer support, or hosting services. Yoloo will always require these third parties to take appropriate organizational and technical measures to protect your personal data and traffic data and to observe the relevant legislation. Yoloo will never share your address book information with any third party, except as may be required by law (see below).

The following is a description of how we may share your Personal Information with trusted third party partners. Should we add additional partners, we will immediately update this description:

• We use third party companies in order to send you an authentication SMS when you register with Yoloo. In order to send you the SMS, we send one of these third party companies your phone number and the authentication message. These third parties are contractually obligated to only use your phone number for the transmission of the authentication SMS.
• If we fail to send you an SMS (this happens in certain cases) you may ask us to call you and read you the authentication code on the phone. This is done using a third party automated phone system. In order to call you, we provide this third party partner with your phone number and send the "audio content" of the call to them. The third party partner in turn will typically use another phone provider who may use another phone provider and so on until the call reaches you. This is an industry standard mechanism for the transmission of phone calls. The third party partner is contractually obligated to only use your phone number for the completion of the authentication phone call.
• We may use Push Notification Services to notify you about various events related to the app. If we do, the phone number or the name of the person calling you or sending you a message may be part of the notification. This message is sent to the push notification service provider, for delivery to your device.
• We use third parties to process the payment and/or billing information that you submit on our Site or through the Yoloo Apps to facilitate payment transactions. We require that these third parties take the appropriate organizational and technical measures to protect your personal data and traffic data and to comply with relevant laws, but we are not liable or responsible for these third party transactions. Therefore, you should review such third party terms and conditions before providing your payment or billing information.

We may disclose information about you if we determine that for national security, law enforcement, or other issues of public importance that disclosure of information is necessary.

We may from time to time ask you to provide information about your experiences, which will be used to measure and improve quality. You are at no time under any obligation to provide such data. Any and all information which is voluntarily submitted in feedback forms on the Site or any survey that you accept to take part in is used for the purposes of reviewing this feedback and improving the Yoloo software, products and websites.

We may contact you to send you messages about faults and service issues. Furthermore, we reserve the right to use email, the Yoloo software or SMS to notify you of any eventual claims related to your use of our software, websites and/or products, including without limitation claims of violation of third party rights.

We may send you alerts via the Yoloo software to notify you when someone has tried to contact you. We may also use the Yoloo software to keep you up to date with news about our software and products that you have purchased and/or to inform you about other Yoloo products and related information.

Children's Privacy

Yoloo websites and software clients are not intended for or designed to attract anyone under the age of 13 and we do not intentionally or knowingly collect Personal Information on our sites from anyone under the age of 13 (or older in some jurisdictions). We encourage parents to be involved in the online activities of their children to ensure that no information is collected from a child without parental permission.

Security

We take reasonable precaution to protect Personal Information from misuse, loss and unauthorized access. Although we cannot guarantee that Personal Information will not be subject to unauthorized access, we have physical, electronic, and procedural safeguards in place to protect Personal Information. Personal Information is stored on our servers and protected by secured networks to which access is limited to a few authorized employees and personnel. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure.

Business Transitions

In case of any business reconstructions, such as a merger, acquisition by another company, or sale of all or a portion of our assets, Personal Information will likely be among the assets transferred. As part of such changes the new entity will be required to commit to the same level of protection of your Personal Information as described in this Privacy Policy. If we cannot obtain such a commitment, we will not perform the business reconstructions.

Change Or Removal Of Information

If you no longer wish to receive e-mail communication from us, such as offers, updates and newsletters, you may refuse to receive these communications by following the instructions included in each newsletter or communication. In addition, you can remove your e-mail address at any time by sending an e-mail with the subject line of UNSUBSCRIBE to support@yoloo.online.

Due to technological reasons, we do not know if and when you delete the application. Therefore, if we detect no activity from your device for 1 year, we will assume that you deleted the application and we will remove your Yoloo account from our servers. Please note that your Yoloo credit (balance) shall expire together with account removal.

If you wish to delete your account completely, you may do so by sending an e-mail to support@yoloo.online advising us of your request. Please note that this will remove your data from Yoloo, and deactivate Yoloo on your device. If you have additional concerns and/or requests, you can contact Yoloo at support@yoloo.online.
